Terms of Use

These Terms of Use ("Terms") govern your access to and use of the MODL mobile application (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

Eligibility

You must be at least 13 years old to use MODL. By using the App, you represent that you meet this requirement and have the legal capacity to accept these Terms.

Your account

You are responsible for keeping your account secure and for any activity that occurs under it. Notify us immediately if you suspect unauthorized use of your account.

Acceptable use

You agree not to:

• Upload content you do not have the right to use, including other people's photos without their consent.
• Upload content that is illegal, abusive, harassing, defamatory, or sexually explicit.
• Use the App to infringe intellectual property rights.
• Attempt to reverse engineer, decompile, or interfere with the App's operation.
• Use automated tools to access the App or exceed normal usage limits.

We may suspend or terminate your access at any time if we believe you have violated these Terms.

Your content

You retain ownership of the photos and other content you upload ("Your Content"). By uploading Your Content, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the App's features to you (for example, generating a try-on result and saving it to your wardrobe). This license ends when you delete the content or your account.

AI-generated results

MODL uses artificial intelligence to generate try-on images, size recommendations, and styling suggestions. These results are produced algorithmically and may be inaccurate, imperfect, or inconsistent. They are provided for informational purposes only and should not be relied on as a guarantee of how a garment will actually look, fit, or perform.

Subscriptions and billing

• MODL offers optional auto-renewing subscriptions with monthly and annual terms.
• Payment is charged to your Apple ID at the confirmation of purchase.
• Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in Settings → Apple ID → Subscriptions on your device.
• No refunds are provided for the unused portion of a subscription term, except where required by law.
• Prices are shown in the App prior to purchase and may change with notice.

Third-party services

MODL relies on third-party services to operate, including Apple, Supabase, Fashn.ai, and Google Gemini. Your use of the App is also subject to the terms of those services where applicable.

Intellectual property

The App, including its design, software, branding, and content (other than Your Content), is owned by MODL and protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for its intended purpose.

Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated results will be accurate.

Limitation of liability

To the fullest extent permitted by law, MODL will not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the App. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim arose (or $50, whichever is greater).

Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App.

Governing law

These Terms are governed by the laws of the United States and the state in which MODL is established, without regard to conflict of law principles.

Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, notify you in the App or by email. Continued use of the App after changes take effect means you accept the updated Terms.
